⚡An environmental decision is the cornerstone of any major renewable energy investment. The process of obtaining one is time-consuming and fraught with procedural pitfalls. Any mistake could potentially delay or even prevent the development of the investment. How will the amendment to the Environmental Protection Act, planned for 2026/2027, affect the value and pace of your investments?
📑Currently, obtaining an environmental conditions decision (OUŚ decision) for infrastructure, energy or industrial projects involves lengthy delays, numerous interpretative ambiguities and the risk of delays at the consultation or public participation stage. However, there is a potential ‘light at the end of the tunnel’ in the form of a comprehensive amendment to the Act on Access to Information on the Environment and its Protection, Public Participation in Environmental Protection and Environmental Impact Assessments (‘the EIA Act’), proposed by the Ministry of Climate and Environment, scheduled for 2026/2027. The draft amendment introduces a number of changes and several new legal institutions which could potentially speed up and simplify your investment projects in a meaningful way.
