The Supreme Administrative Court (NSA) has confirmed the possibility of developing wind farms under the ZPI scheme, thereby putting an end to a months-long dispute over interpretation that had, in practice, slowed the pace of development for many renewable energy projects in Poland.

From the perspective of the market and investment practice, the ruling is of significant importance for the further development of the renewable energy sector. It means greater predictability in planning processes, a reduction in legal risks associated with the use of ZPI, and the possibility of moving forward with projects that have remained in the planning stage for many months.
The commentary also noted that proper conduct of the planning process and establishing appropriate cooperation with the municipality at an early stage of the investment are now of key importance.
