Yesterday, following a hearing, the Supreme Administrative Court fully upheld our position regarding the admissibility of the Integrated Investment Plan (ZPI) for wind farms.
Crucially, the Supreme Administrative Court also confirmed our position regarding which regulations specifically govern the IPI procedure and, consequently, how to properly conduct the entire process of its development and adoption. This also applies to such critical issues as, for example, the interpretation of the scope of the so-called main investment area.
The court left no room for doubt in this regard.
This ruling marks the culmination of our many months of comprehensive work—which began with advising on the preparation of an application to the municipality, along with a draft ZPI and a draft resolution of the municipal council granting consent to the ZPI procedure, and concluded with representing the municipality in proceedings before administrative bodies and administrative courts.
Along the way, we faced both the position of the Provincial Governor and an unfavorable ruling by the Provincial Administrative Court. At the same time, many doubts were emerging in the market regarding the very possibility of using the ZPI for wind projects. From the very beginning, we consistently maintained the position that the applicable legal provisions provide for such a possibility and leave no room for doubt in this regard.
We are all the more pleased that the Supreme Administrative Court has unequivocally confirmed this interpretation.
Jacek Kosiński personally had the pleasure of representing the plaintiff municipality during the hearing before the Supreme Administrative Court. Special words of appreciation and congratulations, however, are due to attorney Dr. Aleksandra Błaszczyńska-Śmigielska, who conducted the entire proceedings with full commitment and great attention to every detail.
